FEES AND EXPENSES FOR LABOR-MANAGEMENT ARBITRATION
Hearing Time: My per diem charge is $1,200 (Outside upstate New York: $1,600). It applies to each day reserved for hearing. When the time at the hearing exceeds six (6) hours in a single day, an additional partial or full per diem may be charged, depending on the circumstances.
Cancellation or Postponement: I do not charge a cancellation or postponement fee as long as I receive notice of the cancellation or postponement before the scheduled hearing date (or, if earlier, before I leave Penn Yan to travel to the hearing location). In the absence of such notice, the day reserved for hearing must be paid for in full. Unless a cancellation/postponement fee is due, a docketing fee (see below) will be charged.
Study Time: My per diem charges also applies to each six (6) hours of actual time I spend reviewing the record and preparing my opinion and Award.
Travel Time: I do not charge for travel time when total actual travel time is less than four (4) hours. When it totals between four (4) and eight (8) hours, I may add a one-half per diem charge. When total travel time exceeds eight hours, I may add a full per diem charge.
Docketing Fee : While no cancellation fee (see above) is charged if the hearing is cancelled before the date scheduled, in the absence of such a fee a $300 docketing fee is charged for administrative time in all cases in which no opinion and award was issued, whether or not a hearing date was scheduled.
Expenses: In addition to paying the fees set forth above, the parties reimburse the transportation, lodging and meal expenses I incur while at the hearing and in traveling to and from it. (If I drive, I charge mileage at the current IRS-approved rate.) I do not charge any office expenses (e.g., telephone, copying, postage, secretarial) to the parties.
